Terms and Conditions

Please read this Agreement carefully to ensure you understand each provision.

These Terms of Service govern your use of Serviceform Oy (business ID / Y-tunnus 2713896-6, registered office Linnaistentie 20 B, 01640 Vantaa, Finland), the website located at https://www.serviceform.com (the “Site”) and the services made available through the Site (collectively, the “Serviceform Service”).

By using the Serviceform Service, you acknowledge that you have read, understand, and agree to be bound by these Terms. An arbitration agreement is included that requires individual arbitration rather than jury trials or class actions.

Your Responsibilities

Users must not utilize the Serviceform Service in violation of any local, state, national, or international law or regulation.

Forms and Submissions

You retain ownership of all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials you submit through the Service. When you designate a Form, Submissions page, or Report as “public,” you grant Serviceform a “worldwide and fully sublicensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform, and publicly display” your submissions. Serviceform does not pre-screen submissions, and you are solely responsible for all submitted content.

Automatic Renewal

Paid accounts are subscriptions billed on a recurring, periodic basis and will automatically renew until cancellation. You may cancel by emailing Serviceform Support. Downgrades remain effective through the current billing cycle.

Credit Card Details

You warrant that credit card information provided is accurate and agree to promptly notify the company of changes. Serviceform may suspend or cancel your subscription if payment cannot be processed.

Downgrades

Downgrading may result in loss of features or account capacity. The company does not accept liability for such losses, though form data and forms themselves are retained upon cancellation or downgrade.

Spam

Serviceform may immediately terminate your account if a form is found to be used in unsolicited email.

Scams

Using the Service or forms created through it for scamming purposes—such as illegally obtaining payment through deceptive means—will result in immediate account suspension.

Phishing

The company may immediately terminate service if a form’s purpose is deceptively obtaining sensitive information such as “credit card information, social security numbers, user login credentials, or other sensitive personal information.” Accounts and violating forms are immediately suspended.

Collecting Sensitive Information

You may not collect credit card information or login credentials. Some sensitive information (social security numbers, driver’s license numbers) may be collected using Serviceform’s security features including SSL and Encrypted Forms. You are responsible for compliance with applicable data protection and privacy laws.

European Data Collection

Personal data collection in Europe requires the EU Safe Forms feature.

Serviceform respects intellectual property rights and disables access to submissions that violate copyright law, suspends service access for violating users, and may terminate accounts of repeat violators.

Trademarks

Serviceform is a registered trademark of Serviceform.com. You are not authorized to use these trademarks; all ownership and associated goodwill remain with the company.

Third-party platforms

Use through third-party platforms (Apple App Store, Google Play Store, Shopify App Store, WordPress.org Plugin Directory, or Meta business accounts) is subject to those platforms’ terms, including Apple Media Services Terms, Google Play Terms of Service, Shopify API Terms, Meta Platform Terms, and WhatsApp Business Solution Terms. You maintain responsibility for your compliant relationship with each platform.

Apple Inc. and Google LLC are third-party beneficiaries of licenses for Serviceform mobile applications installed from their respective stores and may enforce those licenses. No other third party has rights under these Terms.

Payments

Serviceform offers payment processing through Stripe. Users must register with Stripe Connect. By accepting this agreement, you acknowledge reviewing and agreeing to the Stripe Connect Terms of Service and Privacy Policy for your country.

Additional Terms

  1. Termination. Serviceform may terminate service membership or suspend access without notice if you violate these Terms. The company is not liable for removing submissions or suspending/terminating access. You may discontinue participation at any time.

  2. Refunds. Refunds are provided only upon written request via email within 48 hours of the original subscription date.

  3. Modifications To Terms. The company may modify these Terms at its discretion and will post notice on the Site. Objections require ceasing Service use. Continued use indicates acceptance of changes.

  4. Modifications To Serviceform Service. Serviceform reserves the right to modify or discontinue the Service with or without notice. The company is not liable for exercising this right.

  5. Email Communications. Administrative and service-related emails are sent as necessary to operate the Service and cannot be opted out of. Marketing messages (newsletters, product news, promotional emails) are sent with prior consent or soft opt-in for existing customers and include unsubscribe links.

  6. Links. Serviceform provides links for convenience only and does not endorse linked websites or resources. The company bears no responsibility for information found elsewhere.

  7. No Resale Of Serviceform Service. You may not reproduce, duplicate, copy, sell, resell, or exploit the Service for commercial purposes (except User Submissions, which you retain rights to).

  8. Email Delivery. While the company takes steps to ensure email delivery, it does “not guarantee successful delivery of your email notifications.” Mobile apps and regular site checking are recommended.

  9. Form, chatbot or other tool Availability. Serviceform “makes no warranty” that forms will be available 100% of the time and error-free. You bear sole responsibility for damages from errors or unavailability.

  10. Disclaimer of Warranties. Service use is at your sole risk, provided on an “as is” and “as available” basis. The company disclaims all warranties, express or implied, including merchantability, fitness for particular use, and non-infringement. Serviceform makes no warranty regarding meeting requirements, uninterrupted service, timeliness, security, or error-free operation.

  11. Limitation of Liability. To the extent permitted by law, Serviceform and its officers, employees, directors, shareholders, parents, subsidiaries, affiliates, agents, or licensors are not liable for direct, indirect, incidental, special, consequential, or exemplary damages, including loss of revenues, profits, goodwill, use, data, or intangible losses.

  12. Exclusions And Limitations. Some jurisdictions prohibit exclusion of certain warranties or limitation of liability for incidental or consequential damages. Limitations in these Terms may not apply to you. To the extent the company cannot disclaim implied warranties or limit liability, the scope and extent shall be the minimum permitted by applicable law.

  13. Indemnification. You agree to indemnify, defend, and hold harmless Serviceform, its parents, subsidiaries, affiliates, officers, directors, employees, consultants, and agents from claims, liabilities, damages, losses, costs, expenses, and fees resulting from: (a) information you submit through the Service; (b) your use of the Service; (c) your violation of these Terms; and (d) your violation of others’ rights.

  14. Miscellaneous. These Terms constitute the entire agreement between you and Serviceform Oy and supersede prior agreements. The Terms are governed by Finnish law, excluding conflict of law rules and the UN Convention on Contracts for International Sale of Goods. All disputes are subject to exclusive jurisdiction of the District Court of Helsinki as court of first instance, without prejudice to mandatory consumer-protection or supervisory-authority jurisdiction for EU/EEA or UK data subjects. The company’s failure to enforce any right does not constitute waiver. If any provision is found invalid, the court should endeavor to effect the parties’ intentions while keeping other provisions in force. Any claim must be filed within one year or be forever barred. Section titles have no legal effect. All terms and liability limitations remain effective despite termination.

  15. Privacy Policy. By using Serviceform Services you accept these terms and agree to the Privacy Policy.
